These Terms of Service ("Terms") govern your access to and use of SCENE, a product operated by OptiNewsAI LLC, doing business as SCENE ("SCENE," "we," "us," or "our"). By creating an account or using SCENE, you agree to these Terms.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use SCENE. Certain venue recommendations may involve alcohol, nightlife, or adult settings; you are solely responsible for complying with the legal drinking age and all other applicable laws in your location.
You agree to provide accurate registration information, keep your credentials confidential, and use SCENE only for lawful purposes. You may not scrape, reverse engineer, resell, or misuse the service or its data.
You retain ownership of content you submit (reviews, photos, itineraries, vibe feedback). You grant SCENE a worldwide, royalty-free license to host, display, analyze, and use that content to operate and improve the service. You are solely responsible for the content you post and represent that you have all necessary rights to it.
Paid plans (SCENE Plus, SCENE Black, SCENE Business) are billed in advance on a recurring basis through our payment processor. Subscriptions auto-renew until canceled. Fees are non-refundable except as required by law.
SCENE provides predictions, recommendations, and AI-generated content based on third-party data and statistical models. Wait times, crowd levels, vibe ratings, and venue availability are estimates, not guarantees. Your experience may differ.
SCENE relies on third-party APIs (including mapping, places, and venue providers). SCENE is not responsible for inaccuracies, downtime, or content originating from those providers.
To the maximum extent permitted by law, SCENE and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the service. Our total liability shall not exceed the greater of (a) amounts you paid SCENE in the prior 12 months or (b) USD $100.
You agree to indemnify and hold harmless SCENE and OptiNewsAI LLC from any claims arising out of your use of the service, your content, or your violation of these Terms.
Any dispute arising under these Terms shall be resolved by binding individual arbitration administered under the rules of the American Arbitration Association, seated in Delaware, USA. You waive any right to a jury trial or class action.
We may suspend or terminate your access at any time for any breach of these Terms. You may cancel your account at any time from your settings.
We may update these Terms; continued use after changes constitutes acceptance.
